1. Acceptance of Terms

By accessing or using the Pixel Yearbooks platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms apply to all users, including school administrators, staff, and anyone accessing yearbook content.

2. Description of Service

Pixel Yearbooks provides a digital yearbook platform that allows schools to create, publish, and share interactive digital yearbooks. Our Service includes cloud-hosted yearbook creation tools, optional print-on-demand capabilities, and ClassSign booklet options.

3. Accounts and Registration

To use our Service, you must register and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring all information provided is accurate and up to date
• Notifying us immediately of any unauthorized use of your account

4. Pricing and Payment

Pixel Yearbooks operates on a two-phase pricing model:

• Design Software Access: A one-time fee of $350 to access the yearbook creation platform and begin building your yearbook. Design software fees are non-refundable and are required to be paid upfront before activation.
• Publishing Fee: A $699 fee (introductory launch pricing, regularly $899) to publish and launch your completed yearbook.
• The design software access fee is non-refundable once granted.
• The publishing fee is due only when you choose to publish your yearbook.
• Optional printed yearbooks and ClassSign booklets are priced separately.

5. Digital Access and Lifetime Access

The digital version of your yearbook is available for one (1) year from the date of publication. Users may download a PDF version of the yearbook to retain permanent access beyond this period. "Lifetime access" refers to the ability to download and retain a copy, not guaranteed ongoing hosted access.

6. Content and Intellectual Property

You retain ownership of all content you upload to the platform, including photos, videos, and text. By uploading content, you grant Pixel Yearbooks a limited license to store, display, and process that content solely for the purpose of providing the Service. You represent that you have all necessary rights to the content you upload, including rights to use images of students (subject to applicable school consent policies).

7. Prohibited Use

You agree not to use the Service to:

• Upload content that is unlawful, harmful, or violates others' rights
• Share access credentials with unauthorized parties
• Attempt to reverse engineer or circumvent the platform's security
• Use the Service for any purpose other than creating school yearbooks

8. Cancellation

You may cancel your project at any time before publishing. Cancellation before publishing means the publishing fee will not be charged. The design software access fee is non-refundable. There are no long-term contracts or ongoing subscription commitments.

9. Limitation of Liability

Pixel Yearbooks shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or platform notice. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
